14 days in jail, a fine of RM3,000 for genital instructions

KUALA LUMPUR: It's showing his genitals to a woman in public, a worker was arrested 14 days and fined RM3,000 by the Magistrate's Court here today.

Said Saifulakmal magistrate passed the sentence on Mohd Ali Shown, 22, after he pleaded guilty to a charge of showing his genitals to Maxine Ng Mei Cheng, 23, a graphic designer, in front of Berjaya Times Square, Jalan Imbi, Dang Wangi here at 7.40pm, on June 1.

The court also ordered the accused who hails from Sabah was sentenced to three months imprisonment for failing to pay fines.

He did not pay the fine.

The accused was not represented, was charged under Section 509 of the Penal Code which carries a maximum prison sentence of five years or a fine or both.

According to the facts of the case, the incident Mohd Ali approached Ng, who was alone waiting for his cousin at the compound of a shopping center and act touched the shoulder season but not cared about.

DPP Raihanah Abd Razak asked the court to impose a prison sentence and fines by taking into account the actions of the accused caused the victim to suffer trauma.

He said the stress faced by the accused is not a reason for him committing the offense.

"The accused has committed the offense in public areas (Berjaya Times Square) and the accused could affect the country's image in the eyes of tourists," he said.

Before passing sentence, the court took into account Saifulakmal confirmed that the accused had committed a serious offense of a sexual crime.
