MH370: Kes warrant against MAS completed

KUALA LUMPUR: The lawsuit filed two sons MH370 passengers on Malaysia Airlines System Berhad (MAS) and four more, finished, when the suit was withdrawn today.

Federal lawyer Saiful Nizam Shahrin representing the government, told reporters that the two plaintiffs filed a notice of dismissal and withdraw the entire lawsuit against defendants without liberty to file afresh.

He added that the High Court judge Datuk Rosnaini Saub has recorded the withdrawal of the suit, without any order as to costs.

Proceedings in the room was also attended by lawyers for the plaintiffs, Datuk Dr S. Arun and also the mother of the two plaintiffs, aged 14 and 12 years of Pearl Ming Ng, 39.

Meanwhile, lawyer Arun said the suit was settled amicably and the mother of the plaintiff was informed of the announcement by the government recently, and can receive an explanation of the accident.

"It is finally concluded. Son our clients after giving consideration to the rights and legal position had decided to accept compensation and move on," he said.

On Oct 31 last year, two brothers, through their mother, filed a suit with the name MAS, director general of the Department of Civil Aviation (DCA), director-general of the Department of Immigration, Commander of the Royal Air Force (RMAF) and the Government of Malaysia as defendants.

In their statement of claim, the brothers claimed that their father Jee Hang Jing, 41, a local resident, has entered into a contract agreement with MAS flight on a flight from Kuala Lumpur at 12.41 midnight and is expected to land in Beijing at 6:30 am, 8 March.

Plaintiff claimed under the agreement, the MAS as the first defendant should take all steps required to ensure a safe flight, but broke the agreement when the failed landing in Beijing.

Both plaintiffs, among others, claiming damages against the defendants for the loss of their father that they are the sole underwriter, a businessman earning RM16,865 and additional damages due to the suffering experienced by two brothers.

MH370 plane carrying 227 passengers and 12 crew en route from Kuala Lumpur to Beijing, disappeared from radar screens about an hour after taking off from Kuala Lumpur International Airport on the day of the incident and believed to end up in the southern Indian Ocean and have not been found yet so far.
